Terms of Service

1. Agreement to Terms

By accessing or using PricingFast ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference. If you disagree with any part of these terms, you do not have permission to access the Service.

PricingFast Inc. ("Company", "we", "our", or "us") operates PricingFast. The Service is a business-to-business (B2B) pricing experimentation platform that enables you to A/B test Stripe prices and optimize revenue.

By using the Service, you represent and warrant that you have the authority to bind yourself and your organization to these Terms. If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity.

2. Account Registration

To use the Service, you must authenticate via Stripe OAuth. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your Stripe connection and account credentials
  • Accept all responsibility for activities that occur under your account
  • Notify us immediately of any unauthorized use
  • Have proper authority over the connected Stripe account

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are of legal age to form a binding contract.

3. Stripe Connect Authorization

By connecting your Stripe account, you authorize PricingFast to access your Stripe account via Stripe Connect with read and write permissions for the following resources: products, prices, customers, subscriptions, invoices, checkout sessions, and webhooks.

We store encrypted Stripe OAuth access and refresh tokens to maintain your connection. You may revoke access at any time via the Stripe Dashboard under Connected Accounts.

You are responsible for compliance with Stripe's Terms of Service and any applicable Stripe policies. PricingFast does not store credit card numbers or payment card details — all payment processing is handled directly by Stripe.

Revocation of Stripe Connect authorization will immediately terminate your ability to use the Service for that Stripe account.

4. SDK and API Usage

The PricingFast SDK sets a pf_vid cookie (30-day expiry) and uses localStorage to identify visitors for experiment assignment purposes. By integrating our SDK, you agree to:

  • Disclose the use of the pf_vid cookie in your own privacy policy and cookie notice
  • Not abuse, reverse-engineer, or circumvent the SDK functionality
  • Keep your API keys confidential and not share them publicly
  • Comply with applicable rate limits and usage guidelines

We reserve the right to throttle or suspend API access if we detect abuse or excessive usage.

5. Data Processing Responsibilities

With respect to your end-customers' data:

  • You are the data controller for your end-customers' personal data
  • PricingFast acts as a data processor, processing end-customer data solely on your instructions and for the purpose of providing the Service

End-customer data we process includes: visitor IDs (pf_vid), experiment variant assignments, conversion events, Stripe customer IDs, and revenue amounts.

You are responsible for:

  • Having a lawful basis for processing end-customer data
  • Providing appropriate privacy notices to your end-customers
  • Handling data subject requests from your end-customers

A Data Processing Agreement (DPA) is available upon request at support@pricingfa.st.

6. Subscription Plans

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle").

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it. You may cancel your Subscription renewal through your account settings or by contacting us at support@pricingfa.st.

A valid payment method is required to process payments for your Subscription. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service.

7. Billing and Payment

We use third-party payment processors to process payments. We do not store or collect your payment card details. Your payment information is processed by our payment processor in accordance with their privacy policy and terms.

All fees are exclusive of applicable taxes unless otherwise stated. You are responsible for payment of all taxes associated with your purchase.

We reserve the right to modify our pricing with 30 days notice to existing subscribers. Price changes will take effect at the start of the next Billing Cycle following the date of the price change.

8. Refund and Cancellation Policy

You may cancel your Subscription at any time. Upon cancellation, you will continue to have access to the Service until the end of your current Billing Cycle.

Refunds are handled on a case-by-case basis. If you believe you are entitled to a refund, please contact us at support@pricingfa.st within 7 days of your purchase.

We reserve the right to refuse refund requests that are made after 7 days of the original purchase date or for services that have been actively used.

9. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Upload, transmit, or distribute any malicious code or malware
  • Interfere with or disrupt the Service or servers or networks
  • Attempt to gain unauthorized access to any portion of the Service
  • Harass, abuse, or harm another person or entity
  • Impersonate any person or entity
  • Collect or harvest personal information from other users without consent
  • Use the Service for any illegal or unauthorized purpose
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without permission

10. Intellectual Property

The Service and its original content, features, and functionality are owned by PricingFast Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to the content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and providing the Service.

Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

11. User Content

You are solely responsible for your User Content. You represent and warrant that you own or have the necessary rights to submit your User Content and that your User Content does not violate any third-party rights or applicable laws.

We reserve the right (but not the obligation) to remove or refuse to post any User Content for any reason. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to comply with law or court order.

You acknowledge that we have no obligation to pre-screen User Content, but we have the right to refuse or remove any User Content that violates these Terms.

12. Third-Party Services

The Service relies on and integrates with the following third-party services:

  • Stripe — payment processing, connected account management, and billing
  • Supabase — database and backend infrastructure
  • Vercel — hosting and deployment
  • PostHog — product analytics

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such third-party services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party services that you interact with.

13. Data and Analytics

We collect and analyze data about how you use the Service to improve our offerings. This includes:

  • PostHog — product analytics events (feature usage, interactions, funnel tracking)
  • Vercel Analytics — page views, web vitals, and performance metrics

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We make no warranties about the accuracy or completeness of the Service's content.

PRICINGFAST DOES NOT GUARANTEE ANY REVENUE UPLIFT, CONVERSION IMPROVEMENT, OR SPECIFIC BUSINESS OUTCOME FROM USING THE SERVICE. Experiment results are statistical estimates and should be evaluated with appropriate judgment. We are not liable for any revenue loss, customer churn, or other business impact resulting from pricing changes you make based on experiment results.

We are not liable for downtime or service interruptions caused by third-party providers including Stripe, Supabase, or Vercel.

Your use of the Service is at your sole risk. The entire risk as to the quality and performance of the Service is with you.

15. Service Availability

We provide the Service on a best-effort basis. We do not offer a Service Level Agreement (SLA). We may perform maintenance with reasonable notice when possible.

We are not liable for downtime caused by Stripe, Supabase, Vercel, or other third-party infrastructure providers.

The PricingFast SDK is designed to fail gracefully — if our service is unavailable, your website will continue to function normally with default pricing.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRICINGFAST INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Without limiting the foregoing, we are specifically not liable for:

  • Lost revenue or customer churn resulting from pricing experiments or pricing changes based on experiment results
  • Data loss in your connected Stripe account
  • Service interruptions caused by third-party providers (Stripe, Supabase, Vercel, etc.)

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.

17. Indemnification

You agree to indemnify, defend, and hold harmless PricingFast Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your User Content
  • Your violation of these Terms
  • Claims from your end-customers related to data collection via thePricingFast SDK
  • Pricing changes you make based on experiment results
  • Your use of Stripe Connect through the Service

18. Account Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

  • Your right to use the Service will immediately cease
  • You should revoke Stripe OAuth authorization via the Stripe Dashboard
  • Your account data and end-customer experiment data will be deleted within 90 days
  • Stripe OAuth tokens will be deleted immediately
  • You are responsible for removing the PricingFast SDK from your website

If you wish to terminate your account, you may do so by discontinuing use of the Service or contacting us at support@pricingfa.st.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

19. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PricingFast Inc. is registered, without regard to its conflict of law provisions.

Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration, except that each party shall have the right to seek injunctive or other equitable relief in a court of competent jurisdiction.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

20. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms.

It is your responsibility to review these Terms periodically. We will update the "Last updated" date at the top of these Terms when changes are made.
